Terms and Conditions 

Every effort has been taken to ensure these terms and conditions are written in concise and clear English. Should you have any questions relating to any part of these terms and conditions then please call Eclipse Leisure on 01273 727333. 

1. In Writing
In writing means by Facsimile or Letter. We accept no liability for non receipt of any such communication.

2. E-mail
Any communication whatsoever including cancellations and changes made by e-mail will only have deemed to have been accepted once you have received a return e-mail from a member of Eclipse Leisure Ltd confirming your actions. 

3. The event
The event means all bookings made on behalf of a client by Eclipse Leisure Ltd, including but not exclusively hotels, transport, activities, clubs, restaurants, performers and ticketed events.

4. You
You means the client and any persons partaking in any event booked through Eclipse Leisure Ltd. 

5. The Venue
The Venue means any third party booking made on behalf of the client by Eclipse Leisure Ltd, including restaurants, clubs, activities, hotels and transport.

6. Additional charges and Extras
6.1When groups are an odd number on any given night we will when possible book triple rooms incurring no extra cost to the group, however if this is not possible groups of under 14 people will be charged a single supplement of £30 per night when applicable. Groups of 14 and over will not be liable for single supplement.
6.2
Extras include anything not included in the event as detailed by Eclipse Leisure Ltd. These include but not exclusively food, drink, transport, paintballs and shotgun cartridges.  

7. Booking/ Payments
7.1 An initial deposit or any amount agreed is payable on booking. A £30.00 deposit is required from each participant within 14 days of booking to secure their place. The £30.00 is not transferable or refundable. Deposits are payable by credit/debit card or cheque. A cheque deposit must be received within three working days of the booking date, Eclipse Leisure Ltd accepts no responsibility for cheques not being received within this time scale. Eclipse Leisure Ltd reserves the right to change prices or cancel arrangements made should the deposit not be received in the time outlined. The final balance of the account is payable six weeks prior to an event unless otherwise agreed in writing.Eclipse Leisure reserves the right to cancel the booking if the full amount is not received on time. This will result in the loss of all the monies paid.
Any booking made within a six week period will be payable in full unless otherwise agreed by Eclipse Leisure Ltd.
7.2
Eclipse Leisure Ltd reserves the right to charge immediate full payment for all group bookings taken at short notice. Short notice means a booking received with less than 15 working days notice.
7.3
Eclipse Leisure Ltd will not be obliged to dispatch any tickets or documents relevant to the booking until an account has been paid in full. Eclipse Leisure Ltd reserves the right to cancel all or part of any event should payment not be forthcoming as per terms and conditions as laid out in paragraph 7.1.
7.4 Eclipse Leisure Ltd will ensure at all times that the client is fully aware of the event details before any deposit is paid, however start and finish times, exact locations and transport details can only be confirmed on receipt of a deposit.
7.5 Eclipse Leisure Ltd reserves the right to charge a 2% fee over all credit card payments over the telephone. Payments made with switch/debit cards will not incur this surcharge. Payments made online via the group’s web page will attract a £4.00 flat charge.

8. Third Parties
Eclipse Leisure Ltd in making arrangements on behalf of its clients, contracts with third parties for provision of all the necessary facilities including the provision of tickets for entry to the event/occasion. In doing so it is expressly agreed that Eclipse Leisure Ltd acts only as agent of the client and that no liability of any kind howsoever caused shall attach to Eclipse Leisure Ltd in connection with or arising out of such arrangements. The contract between Eclipse Leisure Ltd and the client shall be subject to any terms and conditions of contracts with third parties. In the event that such facilities or tickets shall not be available, for whatever reason, any liability of Eclipse Leisure Ltd shall be limited to the return of all sums paid by the client for such facilities or tickets.

9. Changes
9.1
Every effort will be made by Eclipse Leisure Ltd to alter or change all or part of the event on request of the client. Costs incurred by Eclipse Leisure Ltd will be chargeable to the client; this includes reasonable administration costs which shall be agreed with the client before any changes are made. Please note that any changes requested to be made to your booking within 4 weeks prior to the date of your event will attract an administration fee of £30 Every reasonable effort will be made by Eclipse Leisure Ltd to adhere to confirmed arrangements, Eclipse Leisure Ltd reserves the right at its sole discretion to alter or change arrangements should it be found necessary to do so, and shall have no liabilities whatsoever to the client for any changes, save a refund of any monies not expended.

10. Reduction in numbers
10.1 Wherever possible we will always try and accommodate reduction in numbers incurring no cost to the client. However should the numbers attending be insufficient to run all or part of the event Eclipse Leisure Ltd reserves the right to charge the client for the minimum numbers required to attend all or part of the event. Reduction in numbers will only be confirmed when you have received communication from Eclipse Leisure Ltd.
10.2 No reduction in numbers of people attending an event can be accepted six weeks prior to an event unless other wise agreed in writing by Eclipse Leisure Ltd.
10.3
Invoices relating to dropped numbers will be dispatched by e-mail only. Eclipse Leisure Ltd will only commit to sending two invoices by post, one on booking and one on receipt of final numbers. Invoices can be otherwise be dispatched to you free via e-mail.
10.4
Please note that an uneven number of participants on your group will / may attract a hotel single supplement charge. If triple rooms are available at the hotel booked on your behalf Eclipse Leisure Ltd will do everything possible to allocate one to your group to avoid this surcharge, however, if a single room has to be booked the group will be liable pay for the supplement as prices of group packages are based on shared occupancy (twins, triples or quads).

11. Changes and alterations
Eclipse Leisure Ltd endeavor to visit most of the sites to provide you with accurate and informed information, however we rely on information from all third parties in respect of changes and alterations. Eclipse Leisure Ltd cannot be held responsible for any increase in prices (see extras 6.) or any alteration to the events whatsoever.

12. Disclaimers
In the case of some venues a disclaimer may be required to be signed before the event takes place. Failure to sign the disclaimer to the satisfaction of the third party may result in the event being cancelled. Eclipse Leisure Ltd will have no liability to the client whatsoever in this circumstance. 

13. Activities/ Liability
Every reasonable effort is made to ensure the client’s safety at all times, and that sites used adhere to Health and Safety Acts and have adequate insurance. Some activities contain an element of risk, these include but not exclusively shooting sports of all kinds, motor sports, water sports and air sports. Eclipse Leisure Ltd shall accept no responsibility whatsoever for any injuries or loss incurred by the client or its guests, associates or agents during the event. By booking through Eclipse Leisure Ltd you understand that on your (the clients) behalf Eclipse Leisure Ltd will book activities that may contain an element of risk.

14. Exclusions by third parties
In exceptional circumstances a third party may see fit to stop an activity at any time if they feel continuing an activity would cause injury or harm to its staff or to any other persons at the site. An activity site or venue reserves the right to exclude persons considered to be medically unfit and persons considered to be under the influence
of alcohol. In the cases outlined in this paragraph you will not be entitled to any refund whatsoever.

15. Refund Policy
15.1 On private group deposits - to the value of two people or less - can be refunded within three working days of the booking date. With last minute bookings ( up to  6 weeks prior to the event ), groups cannot be refunded.
15.2
Bad weather makes an event unsafe for participation (see 16.)
15.3 Refunds can be given to individuals who have dropped out and have informed us six weeks prior to the event. This excludes your initial deposit and £30 deposits.
15.4
Should you cancel the event 12 weeks prior to the event a £200 administration charge is payable. All remaining monies shall be refunded ( excluding deposits ).

16. Bad weather
In the event of bad weather making an activity unsafe a venue may cancel an event; you will be entitled to a full refund in regards to that particular activity. Eclipse Leisure Ltd will have no further liability to you. In the event of you not wishing to partake in an activity for whatever reason you will not be entitled to a refund from Eclipse Leisure Ltd. 

17. Complaint Procedure
If at any time during your event, you feel unhappy with your arrangements, ensure to notify the supplier immediately. If the situation has not been resolved between you and the supplier and you are still unhappy you should contact us (eclipse leisure) immediately on our emergency telephone number, which we will provide in advance. Again, if the problem is still unresolved you must send your complaint to us in writing within 7 days of returning from your event. Having received the complaint we will thoroughly investigate the problem to the best of our ability. We are unable to investigate and resolve the problem if this procedure is not carried out. If you do not follow the complaints procedure set out in this section, compensation may be reduced or even lost altogether. If, in the unlikely circumstance that you have to pay for entrance to a venue or an activity that we booked, you must collect a receipt and send it to us, so we can reimburse you for those costs.  Please allow 28 days for a reply after sending your complaint.

18.Agreement
18.1 We believe the above terms and conditions to be fair. This contract shall be governed by English Law and shall be subject to the sole jurisdiction of the courts. If you make a booking with Eclipse Leisure Ltd it is understood you have read, understood and accepted these terms and conditions.
18.2
It is the sole responsibility of any persons booking with Eclipse Leisure to communicate these terms and conditions to all participants of an event.
